1. Acceptance of terms
By accessing or using the website at nwajunkhauling.com (the "Site") or by booking a junk-removal service through the Site or by phone, you ("Customer" or "you") agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated herein by reference.
If you do not agree to these Terms, do not use the Site or our services. By completing a booking, you confirm that you are at least 18 years of age, legally capable of entering into a binding agreement under Arkansas law, and have the legal right to authorize the removal of all items identified in your booking.
These Terms constitute the entire agreement between you and NWA Junk Hauling regarding our services and supersede any prior oral or written communications on the subject.
2. Service description
NWA Junk Hauling provides curbside and driveway junk-removal service for residential and light commercial customers in Northwest Arkansas. Our service model is specifically designed as a curbside operation:
- We do not enter your home, garage, or any enclosed structure. All items must be placed at the curb, at the end of the driveway, or in an accessible outdoor area before our crew arrives. If items are not accessible at the agreed location, the job may be declined or rescheduled (see Section 6).
- We haul items to licensed disposal facilities, recycling centers, or donation sites as appropriate.
- We provide a completion photograph of the cleared area, sent by text to the phone number on file, within a reasonable time after service is complete.
- We offer both same-day and next-day scheduling, subject to availability and the cutoff rules in Section 4.
We do not provide interior hauling, moving services, demolition, asbestos abatement, hazardous-waste disposal, or construction cleanup beyond what is explicitly listed on our website.
3. Service area
Service is available to customers in Benton and Washington County, Arkansas, within the ZIP codes listed on our website. ZIP codes are verified at booking. If your ZIP code is not currently served:
- You will be notified on the booking form and offered the option to join a notification waitlist.
- No charge is incurred for an unserviced ZIP code inquiry.
Addresses in "fringe" ZIP codes (outlying areas of Benton and Washington County) may incur a travel surcharge as disclosed during the booking flow. The applicable fee is shown before payment is requested.
We reserve the right to modify our service area at any time. Changes will be reflected on the Site.
4. Booking and scheduling
4a. Online booking
Bookings are placed through the interactive pricing widget on our Site. You select items or a tier, choose a date and time window, and provide contact and address information. Your booking is confirmed when you receive a confirmation email or text from us.
4b. Same-day service
Same-day service is available when:
- Your booking is submitted before 12:00 PM Central Time on the day of service; and
- The same-day option is shown as available in the booking flow (subject to crew capacity).
Bookings submitted at or after 12:00 PM CT are scheduled for the next available date. A same-day rush fee of $39 applies to all same-day bookings, disclosed and confirmed before payment.
4c. Slot windows
We provide arrival window estimates (e.g., "AM · 4–11 AM" or "PM · 1–11 PM"), not guaranteed appointment times. Actual arrival time within the window depends on routing, traffic, and prior job duration. We will make reasonable efforts to communicate estimated arrival time by text.
4d. Slot availability
Slot availability is managed in real time and is subject to change. Confirmation of a booking locks your slot. If we are unable to fulfill a confirmed booking due to circumstances on our end (crew illness, equipment failure, etc.), we will notify you as soon as practicable and either reschedule at no additional charge or provide a full refund.
5. Pricing and payment
5a. Pricing
Prices are displayed on the Site and are calculated based on the tier or individual items selected. The price shown in the booking confirmation is the price you will be charged — we do not add undisclosed fees after booking. The following fees are disclosed during the booking flow and included in the confirmed total:
- Service minimum: $89 minimum order value applies to all bookings.
- Same-day rush fee: $39, added when same-day service is selected.
- Travel surcharge: $15–$30 for fringe ZIP codes, calculated by distance from our service base and shown before payment.
- Pay-now prepay discount: 5% off the pre-discount total when you pay in full at booking.
Prices are quoted and charged in U.S. dollars. Our pricing engine runs server-side and is authoritative; prices displayed on the Site are for reference. In the event of a discrepancy, we will honor the lower of the two prices or, if the server price is materially higher due to an error, contact you before charging.
5b. Pay now
You are redirected to a Square-hosted payment page and charged in full at the time of booking. Payment is processed by Square, Inc. in accordance with their terms of service. The 5% prepay discount is applied to the total before charge.
5c. Pay later (deposit)
A non-refundable $10 deposit is collected at booking via Square to secure your time slot. The remaining balance (at the standard, non-discounted rate) is due at pickup and collected by the crew at time of service. The exact remaining balance is disclosed during booking and in your confirmation.
5d. Price matching and adjustments
If the volume or weight of items presented for pickup materially exceeds what was booked (e.g., more items than the selected tier covers), we reserve the right to request payment of the difference or decline to haul the excess items. We will inform you before loading any additional items and obtain verbal or written authorization for any additional charges.
6. Cancellation and refunds
6a. Customer cancellation — pay-now bookings
- More than 24 hours before your booking window: Full refund to the original payment method. Please allow 5–10 business days for the refund to appear, depending on your card issuer.
- Between 2 and 24 hours before your booking window: 50% refund. The remaining 50% compensates crew scheduling and routing costs.
- Less than 2 hours before your booking window, or after crew has been dispatched: No refund. The service is considered substantially initiated.
- After items have been loaded: No refund. Service is complete at the time of loading.
6b. Customer cancellation — pay-later bookings
The $10 deposit is non-refundable under all circumstances. It represents compensation for holding your time slot. The remaining balance is due only upon completion of service and is not collected if you cancel before your booking window.
6c. Items not accessible at arrival
If our crew arrives and items are not accessible at the agreed curbside or driveway location and the job cannot be completed, a trip fee of $39 applies (or the full booking amount, whichever is less). We will contact you before departing to offer a reschedule option at the standard rate.
6d. Our cancellation
If NWA Junk Hauling cancels a confirmed booking for any reason within our control, you will receive a full refund (for pay-now bookings) or full deposit refund (for pay-later bookings), plus the option to rebook at the same price.
6e. To cancel
Cancel by texting or calling us at (918)800-1249 / (479) 426-9449 or emailing help@nwajunkhauling.com with your booking reference. Cancellations are effective upon our acknowledgment.
7. Prohibited items
We cannot and will not haul the following items due to safety, legal, or disposal-liability requirements. Presenting prohibited items for pickup without disclosure is a material breach of these Terms.
We cannot haul:
- Paint, stains, varnish, lacquer, or similar liquid coatings
- Solvents, thinners, or chemical cleaners
- Motor oil, transmission fluid, or other petroleum-based liquids
- Gasoline, diesel, or other fuels (including partial containers)
- Propane tanks, compressed gas cylinders, or aerosol cans (full or unknown)
- Tires (residential quantities of 1–2 tires may be accepted by prior arrangement; commercial quantities are excluded)
- Automotive or household batteries in damaged, leaking, or unknown condition
- Asbestos-containing materials (popcorn ceilings, old insulation, floor tiles from pre-1980 construction)
- Medical or biohazardous waste, sharps, pharmaceuticals
- Ammunition, firearms, or explosive devices of any kind
- Any material classified as hazardous waste under Arkansas Hazardous Waste Management Act (Ark. Code Ann. § 8-7-201 et seq.) or RCRA
If prohibited items are discovered after loading, we reserve the right to return them to the property and charge the applicable service fee. Customer will be responsible for any fines, cleanup costs, or legal liability arising from non-disclosed hazardous materials.
8. Customer responsibilities
- Ownership and authorization: By booking a removal, you represent and warrant that you are the legal owner of all items to be removed, or that you have the express authority of the owner to authorize their disposal. You are solely responsible for any claims arising from disposal of items you did not have the right to remove.
- Curbside placement: All items must be placed at the curb or driveway edge (or another mutually agreed outdoor location) before the crew arrives. Items inside the home, in a locked gate, or in an area the crew cannot safely access will not be hauled.
- Safe access: You must ensure our crew can safely access the pickup location. This includes clear pathways, sufficient turning radius for our vehicle, and no hazardous conditions (unstable stacked items, active pest infestations, aggressive animals, etc.).
- Accurate item disclosure: The tier or item list you select at booking should reasonably represent the volume and type of items to be removed. We reserve the right to adjust pricing if the actual scope materially exceeds what was booked (see Section 5d).
- No structural attachment: We do not disconnect plumbing, gas lines, or electrical connections. Appliances such as refrigerators, washers, and dryers must be disconnected and moved to the pickup location before crew arrival.
- Presence not required: You do not need to be on-site during pickup, but you must be reachable by phone during your booking window to address any access issues or scope questions.
9. Photo, marketing, and review consent
9a. Completion photo
Upon completing your pickup, we photograph the cleared area and text it to the phone number on file as proof of service. This is a standard part of our service and protects both parties. The photo is of the cleared driveway or curb area — not of your home's interior, identifiable personal property, or individuals.
9b. Marketing use
We may use before-and-after photographs of cleared curbside or driveway areas in marketing materials (website, social media, printed materials) without further consent, provided no individuals are identifiable in the photographs, no license plates are visible, and the address of the property is not disclosed.
If you prefer that photos from your service not be used in marketing, please include a note in the "Special instructions" field at booking, or inform our crew at time of service. We will honor opt-out requests.
9c. Reviews
We may ask you to leave a review on Google, Yelp, or Nextdoor after your service. Reviews are entirely voluntary. We will never offer a discount, refund, or other inducement in exchange for a positive review, in compliance with FTC guidelines (16 C.F.R. Part 255) and platform terms of service.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE ARKANSAS LAW:
10a. Service limitations
NWA Junk Hauling's liability for any claim arising out of or related to a single service engagement is limited to the amount paid by the Customer for that engagement. We are not liable for:
- Damage to property items that were disclosed for removal (they are being discarded);
- Incidental, consequential, indirect, or punitive damages of any kind;
- Loss of use, loss of profits, or business interruption;
- Delays caused by weather, traffic, road conditions, or circumstances beyond our reasonable control;
- Structural damage to driveways, curbs, lawns, or adjacent property caused by items the Customer placed there prior to our arrival;
- Items removed in error that were not part of the agreed pickup — please ensure only intended items are placed at the pickup location.
10b. Property damage
If our crew causes damage to your real property (driveway surface, landscaping, fencing) during the pickup, report it to us within 48 hours of service completion. We carry general liability insurance and will work in good faith to address legitimate damage claims. Claims reported more than 48 hours after service may not be covered.
10c. Site and information disclaimer
The Site and all content on it are provided "as is" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
The city bulk-pickup information on the Site (Bentonville, Rogers, Tontitown, Fayetteville, Springdale, Bella Vista pages) is provided for informational convenience and is sourced from municipal government websites. Municipal programs change. We are not responsible for inaccuracies or changes in third-party government programs. Verify current rules with your city directly.
11. Indemnification
You agree to defend, indemnify, and hold harmless NWA Junk Hauling, its owners, contractors, and agents from and against any claims, damages, fines, penalties, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your breach of these Terms;
- Your misrepresentation of ownership or authorization to dispose of items;
- Your failure to disclose prohibited items, leading to disposal liability or regulatory fines;
- Any claim by a third party that items removed were their property;
- Your violation of any applicable law in connection with your use of our services.
12. Website use
You may use the Site for lawful purposes only. You agree not to:
- Scrape, crawl, or index the Site for commercial purposes without our written permission;
- Submit false or fraudulent booking information;
- Attempt to circumvent our pricing, payment, or slot-capacity systems;
- Use the Site in any way that violates applicable federal, Arkansas, or local law;
- Transmit malicious code, viruses, or any material that interferes with the Site's operation.
All content on the Site — including text, pricing, graphics, logos, and the pricing widget — is the intellectual property of NWA Junk Hauling. You may not reproduce, distribute, or create derivative works without our written consent.
13. Independent contractor applicants
These terms apply to individuals who submit a contractor application through the Site's careers page:
- No employment relationship is created by submitting an application or by being contacted for work. Contractors who work with NWA Junk Hauling are independent contractors, not employees. They are responsible for their own taxes, insurance, and compliance with applicable Arkansas and federal law regarding independent contractor status.
- Application data: Information submitted through the application form is used solely to evaluate your suitability for independent contractor work. We retain application records for one year (see Privacy Policy, Section 6). We do not sell or share application data with third parties.
- Eligibility: Applicants must be at least 18 years of age, legally authorized to work in the United States, and hold a valid driver's license. A suitable vehicle (truck, trailer, or cargo van with the described capacity) is required.
- At-will relationship: Any working arrangement with NWA Junk Hauling is at-will and may be terminated by either party at any time, for any lawful reason, without advance notice.
- Background checks: We reserve the right to require a background check as a condition of working together. By submitting an application, you consent to such a check.
- Non-exclusive: Nothing in a working arrangement with NWA Junk Hauling prevents you from working with other clients or companies, unless a separate written agreement specifying otherwise is signed.
14. Affiliate links
Our post-booking confirmation page may display links to third-party services (self-storage, moving companies) through the CJ Affiliate (Commission Junction) network. Clicking these links and making a purchase may result in a commission paid to us at no cost to you. These are commercial relationships; we disclose them in accordance with FTC guidelines (16 C.F.R. Part 255). We do not control third-party sites and are not responsible for their products, pricing, or practices.
15. Governing law and disputes
15a. Governing law
These Terms are governed by and construed in accordance with the laws of the State of Arkansas, without regard to its conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
15b. Informal resolution
Before filing any formal claim, you agree to contact us at help@nwajunkhauling.com and describe the dispute in writing. We will attempt to resolve the issue informally within 30 days. Most disputes are resolved this way at no cost to either party.
15c. Binding arbitration (claims under $10,000)
For disputes where informal resolution fails and the amount in controversy is less than $10,000, either party may elect binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, conducted in Benton County, Arkansas. The arbitrator's decision is final and binding. Each party bears its own attorneys' fees unless the arbitrator finds a claim frivolous.
You may opt out of arbitration by notifying us in writing within 30 days of your first booking.
15d. Jurisdiction for other disputes
For disputes not subject to arbitration, both parties consent to the exclusive jurisdiction of the state and federal courts located in Benton County, Arkansas, and waive any objection to venue or personal jurisdiction in such courts.
15e. Class action waiver
All claims must be brought in an individual capacity. Neither you nor NWA Junk Hauling may bring claims as a plaintiff or class member in any purported class action, collective action, or representative proceeding.
15f. Compliance with Arkansas Consumer Protection Law
Nothing in these Terms limits rights or remedies available to consumers under the Arkansas Deceptive Trade Practices Act (Ark. Code Ann. § 4-88-101 et seq.) or other applicable state consumer protection statutes that cannot be waived by contract.
16. Modifications to these terms
We reserve the right to modify these Terms at any time. When changes are made, we will update the "Last updated" date at the top of this page. For material changes (changes that affect your substantive rights or obligations), we will provide at least 14 days' notice before the change takes effect, either by email to customers with an active booking record or by a prominent notice on the Site.
Your continued use of the Site or services after the effective date of any change constitutes your acceptance of the updated Terms. If you do not agree to updated Terms, you must stop using our services before the effective date of the change.
